Privacy Notice

The German-Australian Chamber of Industry and Commerce (hereinafter referred to as "AHK Australia", "we") recognizes the importance of protecting your personal information and is committed to safeguarding it. We collect and handle your personal information in accordance with our legal obligations, including those under the Privacy Act 1988 (Cth).

This Privacy Notice informs you about the type, scope and purpose of the collection and processing of personal data within our websites www.germany.org.au and https://australien.ahk.de/en/ (hereinafter "Website") and the claims and rights to which you are entitled. The Privacy Notice applies regardless of the domains, platforms and devices used (e.g. desktop, mobile, etc.).

Personal data is all information or opinions that identify you or from which your identity can reasonably be determined, e.g. name, address, e-mail addresses, user behavior. Which data is processed in detail and how it is used depends largely on the services you use with us.

We use various other terms within the meaning of the Privacy Act 1988 in our Privacy Notice. Please refer to Part 2, Section 1 of the Privacy Act 1988 for definitions of these terms.

If you are based in the European Economic Area, you may have additional rights. You can find more information about this in the section "Additional rights".

2. How do we collect your personal data?

We process personal data that we receive from you in the course of your use of our website and, where applicable, our business relationship. In certain cases, we receive personal information from third parties, including publicly available sources in accordance with legal requirements.

We receive personal data e.g,

(a) when you use our website
(b) when you make an inquiry or order services through the AHK Australia website;
(c) when you contact us regarding the services you require;
(d) when you apply or register for membership with AHK Australia;
(e) when you register in the website;
(f) if you use the AHK Australia member app;
(g) for other related correspondence (whether written or electronic);
(h) when you register for, attend or participate in events organized by AHK Australia, including webinars;
(i) conducting customer satisfaction surveys and market research;
(j) in the administration of AHK Australia services; and
(k) if this is otherwise necessary to conduct the business of the AHK Australia.

3. What information do we collect? 

Types of personal information that AHK Australia may collect include (but are not limited to) master data (e.g. name, address), contact details (e.g. email address, telephone number), payment details (e.g. credit card details) and professional information (e.g. role, job title, industry, company, country).

If you participate in an event organized by us (in person or online), we may also collect image or video material of you and use these images and recordings in our publications.

If you consent to website analysis or the use of YouTube when visiting our website, for example, user IDs, usage data and technical data such as browser and device information may also be collected.

If you use the website purely for information purposes, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. When you visit our website, we collect the following access data, which is technically necessary for us to display our website to you and to ensure stability and security. The access data includes the IP address, date and time of the request, time zone difference to Greenwich Mean Time (GMT), content of the request (i.e. name of the specific website accessed), access status/HTTP status code, amount of data transferred in each case, referrer URL (previously visited page), operating system and its interface, language and version and type of browser software, notification of successful retrieval.

4. How do we use your data?

In principle, we limit the collection of your personal data to what is necessary to offer you the products and services you have requested.

We only collect personal information that is necessary for the purposes described in this Privacy Notice or for other purposes that have been specifically disclosed to you. We use fair and lawful methods to collect personal data.

AHK Australia collects, stores, uses and discloses personal data e.g. to:

(a) to make the services of the AHK Australia available to you;
(b) Facilitate and host events for members, both in person and online;
(c) Manage memberships and services, including account opening;
(d) communicate with you about your membership and the services you have requested;
(e) compliance with the legal and regulatory obligations of AHK Australia; and
(f) otherwise manage the business of AHK Australia;
(g) to ensure the functionality and security of our website;
(h) to enable payment processing via our website;
(i) Manage consents of our website visitors
(j) to provide the newsletter you have expressly requested;
(k) perform website analysis activities;
(l) screen applications received via the website, carry out application procedures and manage our talent pool;

Some of the main purposes for which AHK Australia uses and discloses personal data include:

(a) Maintenance of member data;
(b) Provision of services;
(c) Account management and invoicing;
(d) Managing AHK Australia's accounts with you; and
(e) the organization of events.

We may also use and disclose your personal data for secondary purposes. A secondary purpose is a purpose that is related to the primary purpose of collection. Some of the secondary purposes for which we collect your personal information are:

(a) Marketing the services of AHK Australia to you;
(b) Development of services;
(c) Customer and market research; and
(d) to inform you of any changes to AHK Australia's business, services or other offerings that may be of interest to you.
(e) Assertion of legal claims and defense in legal disputes.

AHK Australia does not generally share your personal information with third parties or organizations unless they are contracted or employed to provide administrative services on behalf of AHK Australia and are bound by the Australian Privacy Principles.

When you download the AHK Australia Member App via a link that we provide to you, certain personal information that you have provided to us, such as your name, company name and email address, will be loaded into the App. The following personal information about you will be visible to other users of the app: name, company, title. You can voluntarily provide additional information in the app, such as city, country, industry and your resume, which will also be visible to other users of the app. The app can send you push notifications about upcoming events and AHK news. You can also use the app to communicate with other members. If another member asks you to contact them via the app, you can accept or decline the request.

If you attend or participate in events organized by AHK Australia, you should be aware that they may be recorded and photographed. In the case of online events, such as webinars, your name, image and voice may be seen or heard by other participants, depending on whether the microphone and webcam are enabled on the device you are using. Photos and recordings of such events (both in-person and online events), which may include your image/voice and other personal data, may be made available to the public, including through online channels.

AHK Australia will not use or disclose your personal information for any other purpose unless you have consented to such use or disclosure, or unless permitted by applicable law.

5. Use of your personal data for direct marketing purposes 

As with most businesses, marketing is important to the ongoing success of AHK Australia. Therefore, we reserve the right to contact our members and customers by email for direct marketing purposes and to send you information on new products, services and promotions.

AHK Australia may share your personal data with third parties for marketing purposes. However, you can unsubscribe at any time if you no longer wish to receive marketing communications from AHK Australia. You can object to the sending of marketing emails at any time by sending an email to the contact details mentioned in point 1 or by using the unsubscribe link provided in the marketing email.

 

6. Who receives my data?

Within our company, those departments that require your data to fulfill our contractual and legal obligations will have access to it. We also pass on personal data to the organizations associated with us.

We also use companies in the categories of IT services, telecommunications, advice and consulting as well as sales and marketing. If we pass on data to our service providers, they may only use the data to fulfill their tasks. The service providers have been carefully selected and commissioned by us. They are contractually bound by our instructions, have suitable technical and organizational measures in place to protect the rights of the data subjects, guarantee an appropriate level of data protection and are carefully monitored by us.

Any other transfer of data to third parties only takes place within the framework of legal requirements. We only pass on user data to third parties if this is necessary, e.g. for contractual purposes or on the basis of legitimate interests in the economic and effective operation of our business.

7. Is data transferred to a third country or to an international organization?

As a German government organization and part of a global network of German Chambers of Commerce and Industry, we share personal data with our affiliated organizations in other countries. We also use service providers that store data or operate outside Australia. Currently, the data provided is processed within Australia, the European Union and the United States.

The data transfer takes place in accordance with the legal requirements.

By providing us with your personal information, you agree that we may disclose your personal information to the above overseas recipients where this is necessary or useful for the conduct of our business and you agree that 8.1 of the Australian Privacy Principles does not apply to such disclosures. For the avoidance of doubt: If an overseas recipient breaches the Australian Privacy Principles, that entity will not be bound by the Privacy Act and you will have no recourse under that Act.

If you do not want us to pass on your data to recipients overseas, please inform our data protection officer (contact details under point 1).

8. Do I have an obligation to provide data? 

As part of our website, you must provide the personal data that is technically necessary for the use of our website or for IT security reasons. If you do not provide this data, you will not be able to use our website.

When contacting us, e.g. via contact form or e-mail, you only need to provide the personal data required to process your request. If you would like to make use of our services, you must provide all personal data required for the processing of our services.

If you choose not to provide us with your personal information, we may not be able to respond to your inquiries, process your membership application or provide you with the goods or services you request.

9. Protection of personal data

We treat your personal data with the utmost care. We have put in place appropriate physical, procedural and technical safeguards to prevent any loss, misuse, unauthorized access, disclosure or alteration of personal data. This also applies to the disposal of personal data.

We also protect your data by restricting access to personal data to those employees who need it for their work. Physical, electronic and managerial procedures are in place to safeguard the security and integrity of your personal data.

Our security measures are regularly reviewed and continuously improved in line with technological developments.

10. Access to and correction of personal data

You can contact our data protection officer at any time (see contact details under point 1) to obtain access to the personal data we have stored about you and/or to make corrections to this data.

We may charge you reasonable costs incurred by us in providing you with access to your personal data in our possession. In the rare cases where we deny access, we will provide you with a written notice stating the reasons for the denial.

We are generally not obliged to correct your personal data if we do not believe it needs to be corrected and may refuse to correct it. If we reject a correction request, you will receive a written notification stating the reasons for the rejection.

11. Questions, suggestions and complaints

If you have any questions, concerns or complaints about this Privacy Notice or our handling of your personal information (including where you believe we have breached the Privacy Act or the Australian Privacy Principles), please email our Privacy Officer. The contact details of our Privacy Officer can be found in section 1. Once a request has been made, our Privacy Officer will attempt to resolve the issue and respond to you as soon as possible.

If we have not been able to resolve your issue or you are not satisfied with the way we have responded to your complaint about our handling of your personal information, you have the right to lodge a complaint with the Office of the Australian Information Commissioner.

13. Additional rights for persons domiciled in the European Economic Area

The European Union (EU) has local data protection laws such as the EU General Data Protection Regulation (GDPR) that give individuals in the European Economic Area (EEA) more rights and companies that process their personal data more obligations.

In the following, we inform you about the processing of personal data by us within the scope of the GDPR, as well as the claims and rights to which you are entitled.

Personal data within the meaning of the GDPR are all data that can be related to you personally, e.g. name, address, e-mail addresses, user behavior. Which data is processed in detail and how it is used depends largely on the services you use with us.

In our Privacy Notice, we use various other terms within the meaning of the GDPR. These include terms such as processing, restriction of processing, profiling, pseudonymization, controller, processor, recipient, third party, consent, supervisory authority and international organization. You can find the corresponding definitions for these terms in Art. 4 GDPR.

The above Privacy Notice is supplemented by the following information.

(2) What sources and data do we use? 

Details on how and which personal data we collect can be found in points 2 and 3.

(3) How do we use your data (purpose) and on what legal basis?

Details on the processing purposes can be found in point 4. We process personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR) on the basis of the following legal bases:

(a) Consent

If you have given us your consent to process personal data for specific purposes, the lawfulness of this processing is based on your consent.

Any consent given can be revoked at any time. Please note that the revocation is only effective for the future. Processing that took place before the revocation is therefore not affected by the revocation. The revocation can be sent to the contact details listed under point 1.

(b) Implementation of pre-contractual measures at the request of the person or fulfillment of a contract

When you initially contact us (via contact form or e-mail) and for an order, your details will be processed to process the contact request and its handling.

(c) Establishment of an employment relationship

When you contact us (via contact form or e-mail) in connection with your application, we process your data in order to check your suitability for the position (or any other open positions) and to carry out the application process.

(d) As part of the balancing of interests to safeguard legitimate interests

We may process your personal data to protect our legitimate interests or those of third parties.

(e) Use of cookies and similar technologies

We use cookies and similar technologies in the website. Further information on this can be found under point (12) a).

 

(4) Who receives my data?

We may share your personal data with our affiliates or third parties as set out in section 6.

(5) How long will my data be stored?

We only store your personal data for as long as we need it for the respective purpose.

For security reasons (e.g. to investigate misuse or fraud), log file information is stored for a maximum period of 30 days and then deleted (see point 2 above). Data whose further storage is required for evidentiary purposes is excluded from deletion until the respective incident has been finally clarified.

Where necessary, we process and store your personal data for the duration of our business relationship, which also includes, for example, the initiation of a contract via the contact form or by e-mail.

Applications sent to the AHK Australia will be deleted after 6 months in the event of rejection.

In the event that you have consented to the storage of your personal data in the AHK Talent Pool, regardless of whether you are looking for a position at AHK Australia or at one of our member companies, your data will be deleted if you revoke your consent to data processing or after one year at the latest. If we fill an internally advertised position with you, your data will be stored in our personnel management system.

Insofar as we are subject to statutory retention and documentation obligations, we will retain your personal data for this period. We will also store your data in accordance with the statutory limitation periods.

(6) Is data transferred to a third country or to an international organization?

The data provided will be processed within Australia, the European Union and in the USA, see point 7. In the case of data transfer to the USA, we ensure that the recipients of the data are certified in accordance with the EU-U.S. Data Privacy Framework or that we agree EU standard data protection clauses with recipients without certification. If we base the data transfer on the EU standard data protection clauses, we may take additional security measures to protect your data and to achieve an adequate level of protection for your personal data. You have the possibility to obtain or view a copy of the EU standard data protection clauses. If necessary, we will obtain your express consent for the transfer of data to the USA in accordance with Art. 49 para. 1 lit. a GDPR.

(7) What data protection rights do I have?

Each person concerned has

(a) the right to information in accordance with Art. 15 GDPR (i.e. you have the right to request information about your personal data stored by us at any time),
(b) the right to rectification in accordance with Art. 16 GDPR (i.e. if your personal data is incorrect or incomplete, you can request the rectification of this data),
(c) the right to erasure pursuant to Art. 17 GDPR and the right to restriction of processing pursuant to Art. 18 GDPR (i.e. you may have the right to request the erasure or restriction of processing of your personal data if, for example, there is no longer a legitimate business purpose for such processing and statutory retention obligations do not require further storage),
(d) the right to data portability under Art. 20 GDPR (i.e. you may have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and to transmit those data to another controller without hindrance).

Furthermore, you can revoke your consent with effect for the future.

You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). We would also like to draw your attention to your right to object in accordance with Art. 21 GDPR:

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (e) of Article 6(1) GDPR (data processing in the public interest) and point (f) of Article 6(1) GDPR (data processing on the basis of a balancing of interests); this also applies to profiling based on this provision within the meaning of Article 4(4) GDPR. 

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims.

In individual cases, we process your personal data for direct marketing purposes. You have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising; this also applies to profiling insofar as it is associated with such direct advertising. If you object to processing for direct marketing purposes, we will no longer process your personal data for these purposes.

The objection can be made in any form and there are no costs other than the transmission costs according to the basic rates.

If you would like to exercise your right to object, an informal message, e.g. to the contact details above, is sufficient.

(8) To what extent is there automated decision-making in individual cases, including profiling?

When you access our website or contact us by form or email, we generally do not use fully automated decision-making pursuant to Article 22 GDPR. If we use these procedures in individual cases, we will inform you of this separately if this is required by law. We do not process your data automatically with the aim of evaluating certain personal aspects (profiling).

(10) Use of your personal data for direct marketing purposes 

As with most businesses, marketing is important to the ongoing success of AHK Australia. We therefore reserve the right to contact our members and customers by email for direct marketing purposes and to send you information about new products, services and promotions. We do not need to obtain separate consent from you for this. In this respect, data processing is carried out solely on the basis of our legitimate interest in direct advertising. We use CleverReach GmbH & Co KG, Schafjückenweg 2, 26180 Rastede, Germany ("CleverReach") to send emails. We have concluded a data processing agreement with CleverReach in accordance with the GDPR, according to which they process the data for us strictly in accordance with our instructions. If you have initially objected to the use of your email address for this purpose, we will not send you any emails. You are entitled to object to the use of your e-mail address for the aforementioned advertising purpose at any time with effect for the future. You will only incur transmission costs for this in accordance with the basic rates. Upon receipt of your objection, the use of your e-mail address for advertising purposes will cease immediately. You can object to the sending of advertising emails at any time by sending an email to the contact details specified in point 1 or by using the unsubscribe link provided in the advertising email.

 (11) Newsletter

You have the possibility to subscribe to our e-mail newsletters via our website. The e-mail newsletter "AHK-Insider" informs you at regular intervals about news from our member companies, about the latest news from our work for the German-Australian economy and about upcoming events. The e-mail newsletter "G'DAYGERMANY" is sent out quarterly. In cooperation with Germany Trade and Invest (GTAI), AHK Australia regularly provides information on current developments, market opportunities in Australia and events in Germany.

The only mandatory information for sending the newsletter is your e-mail address. Optionally, we ask you to provide a name so that we can address you personally in the newsletter. In addition, you have the possibility to provide information about your company, your position, your length of service and your interests. On the basis of our legitimate interest, we store your IP address entered by the Internet service provider (ISP) when you register for the newsletter, as well as the date and time of registration, in order to be able to trace any possible misuse of your e-mail address at a later date and to be able to prove the registration process in accordance with legal requirements.

Our email newsletters are sent via CleverReach GmbH & Co KG, Schafjückenweg 2, 26180 Rastede, Germany ("CleverReach"). CleverReach processes the information provided when registering for the newsletter to send and statistically analyze the newsletter on our behalf.

For statistical analysis, the emails sent contain so-called web beacons. This makes it possible to determine whether a newsletter message has been opened and which links, if any, have been clicked on. Technical information is also collected (e.g. the time of access, the IP address and browser and device information (e.g. the operating system). This data is used exclusively for the statistical analysis of newsletter campaigns and is not used to personalize the newsletter. If you wish to withdraw your consent to data processing for statistical analysis purposes, you must unsubscribe from the newsletter.

Data collection and downstream data processing take place if you have expressly consented to the delivery of our newsletter via the double opt-in procedure (DOI). This means that we will only send you an e-mail newsletter if you have expressly confirmed to us that you consent to the sending of newsletters. We will then send you a confirmation e-mail asking you to confirm that you wish to receive future newsletters by clicking on a corresponding link.

You can unsubscribe from the newsletter at any time via the link provided in the newsletter or by sending us a corresponding message via our contact options mentioned above. Once you have unsubscribed, your e-mail address will be deleted from our newsletter mailing list immediately.

(12) Cookies and similar technologies

a) General information

We and any services used by us use cookies and similar technologies on our website, such as web storage or web beacons (see below).

Cookies are stored in the browser on the user's end device. They contain information that is stored about a visited page. The cookie is either sent to the browser by the web server or generated in the browser by a script (JavaScript). The web server can read this cookie information directly on subsequent visits to this page or transmit the cookie information to the server via a script on the website. If cookies are set, they generally collect and process certain user information such as browser and location data and IP address values to an individual extent. Some of these cookies are essential for the functioning of our website, while other cookies help us to improve our website by providing us with insights into how you use the website.

With web storage, information is stored locally in your browser's cache. The stored information is either automatically deleted again after the browser window is closed ("session storage") or remains there so that it can be read again when you visit the website again ("local storage"), unless you delete your browser cache ("browser data").

Web beacons are 1×1 pixel-sized graphics that are implemented in various ways in the website or in emails (newsletters) and are also used to collect and analyze user data.

We store information on your end device if this is absolutely necessary to provide you with our website. Otherwise, data is only collected on the basis of your express consent. If personal data is also processed by individual cookies, the processing takes place for the execution of the contract, to safeguard our legitimate interests in the best possible functionality of the website and a customer-friendly and effective design of the page visit or as a result of your consent. b) Consent management

So that you can manage your consents conveniently, a consent banner is displayed when you first visit our website. We use the consent management service of Piwik Pro GmbH, Kurfürstendamm 21, 10719 Berlin ("Piwik Pro") in the website. You have the possibility to inform about the use of cookies and similar technologies and the processing of personal data in the website and to give your consent to services requiring consent. In this context, the IP address and geographical location, the opt-in and opt-out data, the referrer URL, the user agent, your user settings, a consent ID, as well as the time of consent and the consent type are collected. Your consent settings are stored in a cookie on your end device. The cookie is valid for one year.

If you have given us your consent to set cookies and similar technologies and to process your data, you can revoke your consent at any time with effect for the future via the consent settings in the footer of our website.

The data collection and subsequent data processing are carried out on the basis of our legal obligation to obtain consent for the use of cookies and similar technologies and the processing of personal data, as well as on the basis of our legitimate interest in consent management.

(13) Payment service provider (Paypal)

We pass on your payment data to the commissioned credit institution within the scope of payment processing, insofar as this is necessary for payment processing. If payment service providers are used, we will provide explicit information about this below. The legal basis for the transfer of data is the fulfillment of the contract.

When paying via PayPal, we pass on your data to PayPal (Europe) S.a.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), as part of the payment processing. Your data will only be passed on if this is necessary for payment processing. PayPal reserves the right to carry out a credit check for the payment methods - if offered - credit card via PayPal, direct debit via PayPal or "purchase on account" or "installment payment" via PayPal. For this purpose, your payment data may be passed on to credit agencies on the basis of PayPal's legitimate interest in determining your solvency. PayPal uses the result of the credit check with regard to the statistical probability of non-payment for the purpose of deciding on the provision of the respective payment method. The credit report may contain probability values (so-called score values). If score values are included in the result of the credit report, they are based on a scientifically recognized mathematical-statistical procedure. The calculation of the score values includes, but is not limited to, address data.

PayPal sets cookies that are stored on your end device as part of the payment process on PayPal's own pages. We have no influence on this and are not responsible in this respect.
