As banking transactions and customer relationships increasingly operate across jurisdictions, financial institutions and their advisers must manage complex legal frameworks and heightened reputational risks.

 

This seminar will provide a clear and practical overview of:

  • Cross-border banking instruments – including the enforcement of bank guarantees and similar instruments across different legal systems, and the common challenges that arise in practice.
  • De-banking and adverse credit reporting – examining the legal and reputational implications for banks and customers when services are withdrawn or credit information is reported across jurisdictions.

 

The session will feature Matt Karam, Barrister at New Chambers, and Dr Roman Jordans, Professor of Law at the International University of Applied Sciences. Drawing on both Australian and international perspectives, they will outline the governing principles, key risk considerations, and practical lessons for legal and banking professionals.

 

The discussion will be moderated by Shane Anderton, Financial Services Litigation Partner at Deutsch Miller, and will conclude with a Q&A featuring the presenters and David Irving, Legal Counsel at Deutsche Bank.
